Ex-finance director contests termination

Coos Bay’s former finance director has filed a tort claim against the city, suggesting she was fired because of a confrontation with the city’s auditor in 2006.

Janell Howard’s attorney notified the city in a letter dated Oct. 17, saying she will sue the city for wrongful termination and violating her freedom of speech.

City Manager Chuck Freeman fired Janell Howard on Sept. 23., less than a month after Wal-Mart staff said the certified public account attempted to leave the Coos Bay store without paying for several items.

Freeman said he decided to fire Howard after consulting with the city’s attorney and an attorney from the city’s insurance company.

In a phone call this morning, Howard offered to supply a copy of the letter she sent to the city, but declined to discuss her legal action.

“I think the tort claim speaks for itself,” she said.

In the document, Howard contends city officials wanted to fire her after she spoke out against the city’s former auditor, Wall & Wall. She suggested the city used the Wal-Mart incident to back its decision.

The audit dispute started in October 2006. Howard submitted financial documents to the auditor but then made revisions. The auditor came back to the city several days later, saying he would need to charge the city more to conduct additional work because of the changes.

At the time, Howard disputed the request for more money, suggesting Wall & Wall was taking advantage of the interim city manager, Joyce Jansen. The auditor withdrew from its contract and the city was forced to hire a new auditor to review the city’s financial record. The audit gave the city a clean bill of health.

Howard subsequently filed a complaint against Rob Wall with the Oregon Board of Accountancy. She said she did so as a citizen, rather than as a spokeswoman for the city or its finance department, according to the letter.

Freeman suspended her on July 16, 2007, saying she needed to consult with him first before taking such actions with ramifications to the city. Howard contacted her lawyer, who protested. The city agreed to expunge  the record from her personnel file.

This summer, on Aug. 24, a Wal-Mart employee stopped Howard as she left the store with about $12 of items she hadn’t paid for. Oregon State Police found no reason to charge her with a crime and the Coos County District Attorney R. Paul Frasier agreed, saying there wasn’t enough evidence.

At the time the city fired Howard, Freeman contended it was a trust issue. He suggested the city had concerns beyond the Wal-Mart incident, but would not discuss them.

In Howard’s tort claim, she suggests the other issue was a rumor that she had been barred from grocery shopping at Albertsons. She contends that former City Councilor Cindi Miller told Freeman that former finance director switched price tags while shopping at the store.

This morning, Miller said, “I’m not involved in the investigation in any way.”

In an interview today, Mayor Jeff McKeown said the OSP discovered the Albertsons allegation during its investigation this summer. He didn’t want to talk about the Albertsons issue, but disputed that the auditing disagreement was tied to Howard being fired. He said he was in contact with the head of the state’s audit division, who advised the city how to handle the dispute between Howard and Wall & Wall.

“They are completely unrelated issues,” he said.

Freeman said Coos Bay police looked into the Albertsons allegations when OSP officials recommended an internal inquiry.

“It revealed a pattern of behavior that is not consistent with someone handling $49 million of taxpayer money,” he said.

In Howard’s tort claim, Albertsons’ service operations manager was reported to have said management never barred Howard from the store, never said anything to her, and has neither surveillance footage nor any documentation about any tag switching.

With Ms. Howards departure, there is no longer a CPA in the finance department. I feel the city should have looked harder for a more qualified person to take over this important (and high-paying) job. I suspect qualified people have all been scared off.

After reading the letter from Ms. Howard's attorney to the City Manager, I left with the distinct impression that the City has it's hands full with this matter. It looks like it has nothing to do with the dropped charges at WalMart and everything to do with the Mayor, Interim City Manager, and current City Manager wanting to removed Ms. Howard from her position. This began long before the WalMart incident and increased in frequency and magnitude. The Albertson's investigation was a madcap, last ditch effort to pin something on this lady. We can likely expect this to cost City taxpayers a pretty penny in settlement, legal fees and whatever other damages are imposed. Her salary alone with benefits exceeds $100k per year.

I have been thinking about relocating my family to Coos Bay after visiting your beautiful city this last June. I am a employee of Wal-Mart. After reading this article I have almost changed my mind, your city polictics scare me to death over this incident. As a share holder of Wal-Mart anyone caught stealing dips into my stock holdings, and to be honest with you that hurts. You are only 6 days from your elections, so citizens of Coos Bay you'd better find some write ins quickly. I didn't say I was perfect, I was referring to my integrity and honesty. No...I do not completely consume a donut or any other item while shopping in Walmart, visiting with friends, etc. I wait until I have paid for the item and I leave the store.

And we aren't talking about her kids helping themselves to something without her knowing, either...that would have been a whole different story.

No wonder Walmart has a No Tolerance policy. People coming in and eating donuts, then paying for them on a later date? Maybe. Sounds like Wimpy in the Popeye cartoon!

Does anyone else see anything wrong with an adult consuming items before paying for them?

I have three small kids, and I can't tell you how many times I've reached my car only to find that there was something stuck at the bottom of the cart, or that one of my litte darlings have helped themselves to something when I wasn't looking. I take the items back to the store. It's entirely possible and plausible.

This seems like a convenient excuse to fire a whistle-blower. And that is illegal.

They lost much more than a well-respected Finance Director and CPA. At least 2 other members of the finance staff left out of frustration also. Coos Bay will now go out and attempt to hire a replacement finance director. They usually have an agency do this which isn't cheap. Then I hear that some sort of financial auditor is supposed to come in and go through all the books at some extravagant cost to the taxpayers. On top of all this they will most likely end up having to pay lawyers and/or Janell Howard.

Seems like an awful lot of money is going to be spent just because a couple of inempt city officals didn't like someone. But hey, it's just taxpayer money. They don't care.

What a mess. I don't care who gets on the council, this will be a nightmare for them. I don't care who did or didn't do what, the City of Coos Bay loses. First we lose credibility. Than we lose money. Lots of money. Here are the options. If any part of the allegations are true (even if Miss Howard did intentionally try to leave Wal-Mart) we could lose another City Manager (good or bad). Both Mayoral candidates are under scrutiny. Either Jeff was wrong or John was wrong. Has nothing to do with politics. Or we pay her enough to go away and we never know (the taxpayers lose). She is right and gets paid (the taxpayers lose)and Chuck gets the boot. She is a bonified whistle blower (she gets her job back if she wants it and now Chuck brings suit and the taxpayers lose). Several past Councilers and others like the Wall's who were involved are drug into court and their name smeared. Everybody loses. And the poor newly elected officials in whose lap this falls. Sigh.

Some how this is always someone elses fault but Janell's. I think it is an abuse of Power that she kept her job as long as she did. Why was she working at 3 a/m making changes to an audit? F.Y.I. Wal-Mart doesn't prosecute anyone shop lifting unless they have stolen over $25.oo worth of merchandise, this went pretty much public several years ago. What everyone needs to know is there was no merit found in Janell's claim to the Board of Accountancy, she made hundreds of changes at 3 in the morning to that Audit. Wall and Wall had every right to question her. Someone needs to bring that paperwork back up.

Hey Interesting, I know all I want to know about Ms Howard. My comments were for the other employees that want to leave the city. I believe Ms Howard was asked to leave. I know the difference between right and wrong and guess what? Theft is wrong no matter how many hours you work.

As for the Walmart incident I would have to say the $12.00 worth of items would not be worth the risk. My money is on her just being distracted and walking out of that bee hive of consumer activity with plenty of other things on her mind.

I understand your point, I really do. But our laws were designed this way for a reason. The crime you refer to is unsolved. I am talking about something very different. Look at OJ. We all know he was guilty, but the law says he's innocent of the crime of murder. Our laws are set up this way to protect citizens from discrimination because someone "thinks" they may have done something. You cannot say someone is guilty of a crime unless they have been proven so in a court of law.

Leah Freeman's murderer is still out there but he/she is not innocent. Many crimes in our country have not been resolved but the crime was still committed. This is a drastic example but I hope you get my point.

She got off on a technicallity but there is no doubt she was about to walk out the door with unpaid items, right in front of her children!

hmmm... the World didn't even mention Mckeown's part in the investigation while the Register Guard did. I generally appreciate Alexander's fairness in reporting but in this article he only mentions "city officials". Publish the report please; you published the whole police report and video from Walmart, why not this one?

Thanks for the tip Dottie, but I think everyone should get to see this and not just one person.

If the World truly wants to appear unbiased, don't protect the "city officials" and just tell it like it is. Let us decide.

The whole Albertsons thing was an unsubstantiated rumor that was told to the City Manager, reporting it as anything more than that is slanderous...the Mayor and Chuck Freeman should be ashamed of themselves! Maybe that's why many at city hall are looking for other jobs or wanting to retire!

It is strange that this comes out just prior to the election, and Ms. Howards good friend?!? Mr Muenchrath,Seems to be siding with her. I thought city councilors were susposed to be at least neutral or hands off on personnel matters within the city. They are there for guidance to city staff.
As ar as Ms shoplifter, there has to be a lot more in her background for them to have fired her. Perhaps she should be a bit more forthcoming with the public's shoulder that she is crying on!

Some of the topics on this issue amaze me. Do these people really feel that a mayor or city manager would fire someone without cause? During an election?? How much inapropriate behavior by a department head is enough? And the audit- how about doing your job right the first time and not making the City look bad. Kudos Mayor McKeown and City Manager Freeman!

Thats kinda slimey that Muenchrath now brings up that he is/was not in agreement with her termination. I heard he is just using this as a campaign strategy, not so sure I would want that type of a guy representing my City. What an eye opener.

Pretty simple. Ms. Howard tried stop the city from giving some crooked auditor thousands for work he didn't even do. Since the auditor was good friends with the Mayor, they tried to shut her up. This is the type of people that are running our city.

Interesting how the Register-Guard mentions the $50K she was offered by Coos Bay for her silence, but the World failed to mention it.

If you have more questions regarding the accounting issue, the Registerd Guard did a larger story today and gives more details which don't make Janell out to be such a trouble-maker. She was obligated as a licensed accountant to report Mr. Wall according to that story. I guess the resulting investigation by outside investigators will bring the truth to light.

this is tough call all the way around. You don't fire her and people will question her handling of the books. Do fire her and it looks like you are operating on just allegations with no proof. A little disappointed to see in the R-G that Muenchrath seems to be questioning his City manager and even making this a political issue. maybe if she gets barred from enough stores in town, she will just vacate and move somewhere else, maybe somewhere where people dont know her and she can start all her shenanagons again... it will never stop, and i as well as BIG SURPRISE, hope the city DOES NOT SETTLE on this... if the city settles, it shows they are the guilty ones, not ms howard, i hope the city wins and she gets nothing... this is sooo sooo wrong, maybe i can speed through town, get stopped by a male officer, and fight my ticket and say it was because i was a woman... hmmm sounds like an idea to me, then i could sue the officer for being prejudgest, and get lots of money..

We need the real facts and all of them.

Then the guilty can go to jail and/or resign. I assume we will all be surprised and again disappointed, in the end.

I find it interesting that the World spins this story so much different than the Register-Guard who published it first...talk about biased reporting! It also seems like more than just a coincidence that 2 of the editorials published with this story are in favor of Mayor McKeown. I thought newspapers were supposed to be neutral...this is obviously not the case with The World - don't believe everything you read!

It appears to me Ms. Howard was/is on some power trip. Her answers are always to put blame onto someone else. Hopefully the city does not just settle this to make it go away. I would like to know the truth.
