CB teenager gets two months of jail time plus probation

The parents weren’t home. But their daughter, and their .22-caliber rifle, were.

Whether Zan Walker knew this as he drove through the Catching Slough area to visit his girlfriend on Feb. 6 is unknown, but District Attorney R. Paul Frasier said on Monday that Walker did have some .22-caliber shells in his backpack that day.

The 18-year-old parked outside 63016 Parkway Road, the Eberlein residence. He went into Doug and Toni Eberlein’s bedroom, where he found the rifle. Walker loaded it and walked down the hall toward Chloe Eberlein, their daughter. He said he was unloading the gun, but when he came to the entrance of her room, it wasn’t unloaded.

“The gun’s pointed at her and somehow it went off and hit her in the chest,” Frasier said.

Eberlein was rushed to Bay Area Hospital. She would be fine, but Walker would be indicted on a charge of third-degree assault.

Last week, Walker pleaded guilty to a charge of fourth-degree assault. On Monday, Judge Richard Barron sentenced him to 60 days in jail and two years supervised probation. He also ordered Walker to pay Eberlein’s medical bills and court fees, totaling about $40,000, and told him he must stay away from the Eberlein family and their residence.

Frasier said he did not pursue the third-degree assault charge because it would have required proving Eberlein experienced a life-threatening injury. Although the bullet hit her chest, it was not as serious as it otherwise might have been.

“She’s just a very, very lucky girl,” Frasier said.

She also wasn’t interested in the prosecution of Walker.

“She did not want this pursued at all,” said Frasier. “Obviously, the parents thought otherwise.”

Walker began serving his sentence Monday at Coos County jail.

I'll bet the kid wishes he was pointing the gun in a different direction. I think this was an accident, but I don't know what really went on. Maybe don't point a gun at a person when you are unloading it. Maybe lock your daughters and sons up. Maybe parents should be more involved. Maybe we all have done things we wish we could undo. Maybe I should just shut up.

Just because Frasier said the gun was pointed at her does not mean that Zan knew it was pointed at her, maybe she walked in front of him while he was looking down unloading it when it went off. And no, he is not mentally ill, he was unloading it and it went off. Has anyone tested the gun to make sure it works properly? And the gun should not have been out because their daughter was not 18.

Oh sorry, I guess they should have been better prepared for their daughter's idiot boyfriend to trespass into their house, not to mention THEIR ROOM, and steal their gun to shoot their daughter. Yeah, it's their fault alright. That kid got off easy. You can steal your neighbor's lawn gnome and be sentenced more than 60 days in jail. But apparently in Coos County you can shoot someone, regardless if it is an accident or not...HE STILL SHOT HER, and only be in jail for 2 months. That is just wrong.

I agree, his parents (and ALL parents) should teach kids about gun safety. This could have been avoided. As a teenager I was constantly amazed how many other kids didn't know about guns. I also agree that any home where there is a child, every gun should be locked away. But this was not a child playing with a gun. He was 18, an adult! So, not really the gun owners fault in this case.

He's an adult, made the decision to PLAY with a weapon, and has to be held accountable. I am not here to judge someone or misinterpret what has been said or written. The point that should be picked up here is that as parents we have the responsibility to teach our children what is right or wrong. Parents don't leave guns out of locked safes, and make sure if a child is going to use a gun they have had proper training, which includes knowing when and where to use a gun.
I have been around firearms my whole life. My dad taught me very young that a gun is not a toy. It was only to be used when I was with him or for hunting purposes.
So please make sure your guns are where no child can get to them unless they have your permission and are supervised.

The true criminals are those that add to the story or act like they know what happened that day and then make judgements. Just To Follow up on what I said, How did Zan even know it was a 22? How did he know what shells to bring over? How did he know where the gun actually was? Its not only him that should be accountable but the Parents as well for even keeping a gun in the house where someone can get to it. It is so sad to see how over dramatized Coos County is. People need to turn off their TV or at lease be more selective in what you watch. Leave the drama to Soap Operas and get on with real life. Does nobody in this county beleive an accident can occur? The young man should be held accountable for the medical bills but fining him and putting him in an overcrowed jail makes no sense since the girl did not want to prosecute.

What scares me is that many of the people who are posting nonsense could be sitting on a jury some day. Their need for drama, inablity to be objective or to listen to reason, and their willingness to bear false witness against their neighbor is very disturbing to me.

I am in Iraq and we had an accidental discharge two days ago in the chow hall by a well trained Air Force Security Officer. Nobody was injured but they certainly could have been. The airmen will lose a stripe. Accidents do happen. Zan is guilty of improper muzzle awareness and poor firearm safety. That's it... No malicous intent. Again, he's a good kid and does not deserve to be anywhere near a prison.

Amazing-When he learned to shoot is not the issue. I teach hunter's safety and many kids learn to shoot at a young age. It doesn't make you a killer or a bad person because you know how to use a gun, or any other weapon for that matter. What matters is the choices you make when you use them. It also does not make his parents bad people for teaching him. He made a bad choice and he should be held accountable.

Terrence-I've never accidentally loaded any of my guns.

His dad just bought a gun this year and had taken him out shooting a few times. I was sitting right there at the hospital with my son and his dad and that statement you made is a flat out LIE! And the girl is not afraid of him and they were allowed to see each other when this happened and she is devastated that they cannot see each other. As far as everyone else (Melissa) it is NONE of your business what happened that day. The two people that know what happened are still in love with each other. You are so wrong with your comment. Chloe's parents know what really happened that day. They are the ones who sat through emergency surgery wondering if their daugher was going to make it. They are the ones to sat at her bedside while she was intensive care for two days then in the hospital for another 5 days. They are the ones who have taken care of her both physically an mentally since the shooting. Get over yourself!!

He hurt her...period...Nice kid or not, Chloe could be dead right now....accidents happen, we all know that, but pointing a gun at someone, especially a loaded one, in my book does not constitute an accident. The bullet hitting her chest wasn't that serious? It grazed her heart and lung. Passed through her diaphram and liver and is lodged near a rib. Sounds rather serious to me. It may have been an accident but the first thing the young mans father said to Zan when he saw him at the hospital was " how could this have happened you have been shooting guns since you were six" The fact he just happened to have 22 shells in his backpack seems like quite a coincidence to me.

Being a former Law Enforcement Officer, I can say that from what I read in this that there are a lot of unanswered questions. just because he plead guilty does not mean he is! It is a tactic that I think most lawyers use so their client could have get a light sentence. I am sure Judge Barron would agree with that because it usually includes the judges opinion when the deal is made. The Parents should have listen to the girl to a point but also it sounds like this girl was not suppose to be with him anyway and he may have been warned to stay away by the parents. Like I said there are things here that are not known, so the full truth may never be know except by a few people closely related to the situation. Yes, lets leave these two young adults alone and let them heal and put it behind them.

If a cop breaks someone's neck in the course of subduing them, it goes down as an accident.


Let a teen commit an accident and it's a heavy hit. $40,000? Where is the kid going to make that kind of money? Negligence with guns, vehicles and the use of force results in tragedies but it seems like there is not much for fairness in how these things are handled in Coos County.

Guns don't accidentally pick themselves up, load themselves, point themselves at someones chest, and accidentally pull their own trigger.
This is not what I would consider being held accountable for his actions.

This article made the accused sound like the victim! This newspaper and all of the people who chose to make up their own story without knowing the facts owe the Eberlein family a huge apology!

It's just ridiculous that he would get such a light sentence. He may or may not have done this intentionally but he should be punished for his stupidity. Even as a young child I knew NEVER to point a gun (loaded or unloaded) at anyone! As far as the girl not wanting him to be prosecuted...of course she didn't, most teenage girls don't stand up for themselves. They believe "love" fixes everything. Good for the parents/prosecutor for charging him anyway. Even if the sentence is not appropriate.

Maybe you should know the facts before you post ridiculous comments. The fact is, is that the shooting was an accident and even the girl that was shot said so and didn't want any charges pressed. I know this boy too and he is a great young man that would never want to hurt anyone, especially this girl. Everyone needs to leave both of these young people alone and let them heal, they have both been through hell and back!

OMG, My Daughter goes to school with this boy. And it amazes me that he can get away with this.But if you deal drugs in this town or walk down the road drunk you do more time in jail than if you shoot someone dont get me wrong i am against drugs but it seems to me that the Mr Fraiser would not give the shooter less time than the drug dealer. It is a outrages and if this were my child that was shot i would fight the DA tooth and nail before i would allow this boy to basically get away with it whether my Daughter liked it or not!!!!
