Notice is hereby given that a Public Hearing has been set before the Planning Commission of the City of Bandon, regarding the application for a Zone Code Text Amendment to modify the Bandon Municipal Code Section 17.20 Controlled Development 1 (CD-1) Zone, to allow for a building height up to 45 feet, side yards of 5 feet, a rear yard of 5 feet, and a 55% lot coverage with up to 75% impervious surface, on specific properties located in the CD-1 Zone in the City of Bandon. Time will be allowed for your verbal testimony at the hearing. It is recommended that testimony be presented in written form. Please note the deadlines below for submitting testimony: 5:00 pm, April 18, 2018: Deadline for inclusion of testimony in meeting packet. 5:00 pm, April 25, 2018: Deadline for electronic (e-mail or FAX) testimony. 5:00 pm, April 26, 2018: Deadline for receipt of hand delivered or US mail testimony. After 5:00 pm on April 26, 2018: Testimony must be presented at the hearing. The ordinance criteria applicable to this application are available to review online at www.cityofbandon.org. Oregon law states that failure to raise an objection concerning this application, either in person or by letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue, precludes your right of appeal to the Land Use Board of Appeals (LUBA) on that issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of appeal to LUBA on that criterion. A copy of the application, all documents and evidence relied upon by the applicant and applicable criteria are available for inspection at no cost and will be provided at reasonable cost, if requested. A copy of the Staff Report will be available for inspection seven days prior to the hearing and will be provided at reasonable cost, if requested. During the Public Hearing, the Chair shall allow testimony from the applicant and those in attendance concerning this request.
